HURRICANE — Southern Utah manufacturer Pace American recently sponsored a food and clothing drive to benefit the Dixie Care and Share shelter in St. George.

Pace American employees divided into department teams and competed to see which team could gather the most donations.

Painful...But Better



Six months of horrific job losses gave way to a "still terrible but at least moving in the right direction" employment report for the month of May. The reported 345,000 job decline was sharply below the consensus forecast of a loss near 520,000 jobs.  It was also the lowest number of reported monthly job losses in the past eight months.

Paunsaugunt Cliffs Subdivision Sold Out!



If any of you have had the chance to head over Cedar Mountain to Paunsaugunt Cliffs near Hatch, Utah, you will have to agree that it is one of the most awesome sights you will ever behold. I hit Paunsaugunt Cliffs one evening just as the sun was setting and a light rain was falling. Pay To Wait or Wait to Pay?



The United States Supreme Court is poised this year to consider two cases on when employees must be paid under the Fair Labor Standards Act (FLSA) for time spent waiting as part of their jobs. Meanwhile, a federal court in Ohio has ruled that an employer there violated FLSA when it failed to pay employees for time spent preparing for the workday and traveling to work sites.
FLSA says that waiting or prep time spent “predominantly for the employer's benefit” that cannot be used for an employee's “own purpose” must be paid. We will have to wait‒unfortunately without pay-- for the Supreme Court to shed further light on this issue.

Phase Two Redundant Fiber Line Moving Forward As Planned



Gene Morris, President of Utah Interlinx announced recently that Phase Two of the redundant fiber optic line is under construction and progressing according to plans. Completion of Phase Two of the fiber optic line through Ivins, UT, will make the interlinx fiber network and interconnect completely diverse and redundant.
The new next-generation Sonet and Gigabit Ethernet Metro-Area Network (MAN) already installed and carrying communications traffic will be further protected from service interruption by virtue of a 50ms automatic switch-over in case of disruption on the primary fiber route.
This network is capable of carrying virtually unlimited amounts of voice (including analog and IP), data (internet) and video (also including analog and IP video) services to businesses and residences in the region.
According to Morris, "The Utah Interlinx network is 'open access' - allowing for various service and content providers to utilize it without expending infrastructure capital - thus attracting more choices of newer and better telecommunications services in southern Utah."
Morris also reported that the Interlinx MAN fiber ring passes directly through the new Main Street Plaza facility providing protected communications services to not only the building tenants but also to many other business complexes in proximity of MSP. He also stated that Interlinx is in the business of building private networks to serve financial, government and health care offices within the St. George metro area. Interlinx is also in the process of completing the construction of a private fiber network for Washington County.
The InterLinx network connects into the FTV fiber corridor (commonly known as the Williams Pipeline Route), which is part of a major long-haul OC-192 Sonet backbone ring at a site north of the Shivwits Indian Reservation. Both of the Phase 1 and 2 long-haul fiber optic lines will terminate at the Tonaquint Center Hi-Tech Business Park.

Phone Service through the Internet?

The last few months I have written about Voice Over IP(VOIP) technology and how it will change telecommunications. I can now give a first hand account that it is much cheaper than a conventional phone line. I signed up with a local vendor and I am pay 19.99/month for Unlimited Long Distance Anywhere in the US. This plan is only available for residential subscribers, but I am impressed by the business offerings from the providers I found who are local in St. George, Cedar City, and even Beaver.
Business Users usually pay a bit more for long distance since they primarily use the phone during the “expensive” times of day. Cell Phones are not any different. But the concept that caught my eye from the VOIP providers is the Business Centrex Lines.
Centrex lines have been available for many years, but I have still not been able to find out how long they have been available in St. George. They differ from regular business lines in the features. The Centrex services were designed to give businesses all the features of a private PBX (very costly) system but without paying the high cost for equipment.
With VOIP Centrex, a small business can now have all the features of the largest corporation without the tens of thousands of dollars in costs. Add to this the features of cheaper long or in some cases unlimited US long distance and you business can really see savings.
The only requirement and potential downside to a VOIP connection is that it needs to have a GOOD Internet connection. I have noticed at my house that when I download large files the voice quality on my line fades to something like being on my cell phone in the Virgin River Gorge. My Wife described the phone as growling a lot one time. One other difference is that you have to do 10 digit dialing when you call out: 1-435-xxx-xxxx even for local numbers.
Vonage is the largest VOIP provider and does a great job with Advertising. Unfortunately if you sign up with them, you are limited to the Wasatch Front, Tooele, and Park City. If you sign-up with Nuvio Internet Services (sold locally by Digital Rapids) or Packet8 (resold by packet8.net), you can get a local number. Mine has a 215 prefix and it works very well including the Voice Mail.

CEDAR CITY — A pipe manufacturer has begun hiring production workers to staff its new plant expected to begin operating in early January in the Port 15 Industrial Park.

Forever stamp a big seller

With a postal rate increase just a week away, Americans are buying millions of Forever stamps a day.

The cost of sending a first-class letter will rise a penny to 42 cents on May 12, but the Forever stamps - selling for 41 cents until that date - will remain valid for full postage after the increase.

Forever stamps were introduced last year and since then more than 6 billion have been sold, with interest growing as the rate increase nears. Unlike the Forever stamps, other 41-cent stamps will require additional postage when the new rates take effect.

The Utah Department of Natural Resources announced last week that the estimated construction cost of the Lake Powell pipeline project has jumped from $800 million to just over $1 billion.

President Bush Signs the Fair and Accurate Credit Transactions Act of 2003


On December 4, 2003, (last year)President Bush signed into law the Fair and Accurate Credit Transactions Act of 2003, ensuring that all citizens are treated fairly when they apply for a mortgage or other form of credit.
The legislation will provide consumers, companies, consumer reporting agencies, and regulators with important new tools that expand access to credit and other financial services for all Americans, enhance the accuracy of consumers' financial information, and help fight identity theft. These reforms make permanent the uniform national standards of our credit markets, and institute new, strong consumer protections.
Background
The Fair and Accurate Credit Transactions Act of 2003 will accomplish the following key Administration priorities to help ensure that all Americans, of every income level and background, are able to build good credit and confront the problem of identify theft:
Ensuring that lenders make decisions on loans based on full and fair credit histories, and not on discriminatory stereotypes. In 1996, uniform national standards were established to set clear rules on what credit agencies were entitled to include in individual credit reports, and now more than a million Americans have credit as a result. This legislation makes those national standards permanent.
These standards include giving every consumer the right to their credit report free of charge every year. Consumers will be able to review a free report every year for unauthorized activity, including activity that might be the result of identity theft.
Helping prevent identity theft before it occurs by requiring merchants to leave all but the last five digits of a credit card number off store receipts. This law will make sure that slips of paper that most people throw away do not contain their credit card number, a key to their financial identities.
They also include creating a national system of fraud detection to make identity thieves more likely to be caught. Previously, victims would have to make phone calls to all of their credit card companies and three major credit rating agencies to alert them to the crime. Now consumers will only need to make one call to receive advice, set off a nationwide fraud alert, and protect their credit standing.
Another permanent standard includes establishing a nationwide system of fraud alerts for consumers to place on their credit files. Credit reporting agencies that receive such alerts from customers will now be obliged to follow procedures to ensure that any future requests are by the true consumer, not an identity thief posing as the consumer. The law also will enable active duty military personnel to place special alerts on their files when they are deployed overseas.
This includes requiring regulators to devise a list of red flag indicators of identity theft, drawn from the patterns and practices of identity thieves. Regulators will be required to evaluate the use of these red flag indicators in their compliance examinations of financial institutions, and impose fines where disregard of red flags has resulted in losses to customers.
The standards even go so far as to require lenders and credit agencies to take action before a victim even knows a crime has occurred. With oversight by bank regulators, the credit agencies will draw up a set of guidelines to identify patterns common to identity theft, and develop methods to stop identity theft before it can cause major damage.
This legislation gives consumers unprecedented tools to fight identity theft and continued access to the most dynamic credit markets in the world. With a free credit report and powerful new tools to fight fraud, consumers have the ability to better protect themselves and their families.

Princeton Review Names SUU One of the Best, Again!



For the second year in a row, Southern Utah University has been chosen by The Princeton Review as one the best institutions of higher education in the country.
The Princeton Review, which focuses on identifying colleges and universities that stand out in each region, has designated SUU as one of the “Best in the West” colleges and universities.
SUU made the list because of notable ratings in Academics, Quality of Life, Admissions Selectivity, and Financial Aid.
The Princeton Review based its decision of which schools to feature on the list by asking current students more than 70 multiple-choice questions about their respective schools. Students also had the opportunity to share their opinions through short-answer responses.
Some of these responses are quoted on The Princeton Review's Web site, ranging in topic from the university's size and financial affordability to its outstanding academics and convenient location.
Students commented on SUU's friendly atmosphere, with one saying, “Everyone smiles and says ‘Hello' when you walk through campus.”
Other comments described the school's typical student as “studious, but fun” and saluted SUUans for their school pride and caring ways.
Several of SUU's academic entities received praise from students, as well, particularly its College of Education, School of Business and College of Performing & Visual Arts.

Council will look at the issue again

CEDAR CITY — A consulting firm has proposed the city double the impact fees charged for new home construction. Predictably, home buyers and those affiliated with the building industry oppose the idea.

Under the proposal, total impact fees charged on a single-family home would increase 116 percent, from $4,609 to $9,965. Cedar City has not adjusted impact fees for 10 years.

The proposed increases in individual fees are significant - 227 percent for police, 194 percent for parks and recreation, 174 percent for transportation.

Proposed Changes to Aerospace and Aviation Development Zones Would Help Rural Utah


One of the most exciting economic development bills passed by the 2003 Utah State Legislature was the Aerospace and Aviation Development Zone Act. This legislation allows the Utah Department of Community and Economic Development to approve zones around airports where aerospace and aviation firms could earn rebates of 50% of the state revenues they generate in any year. (30% over the life of the project).
These revenues would include sales tax, income tax, and corporate franchise and income tax. Zones can only be created at airports with manned air traffic control tower and instrument landing system capabilities. This last restriction will sunset on July 1, 2006 unless the Legislature chooses to extend it for an additional period.
While this legislation is a powerful economic development tool, it has no value for rural Utah until the control tower restriction is lifted. Public Safety Driving and Identification Card Amendments
Questions and Answers

In an effort to inform and educate businesses in Utah regarding the new Driver's License Law, the Office of Ethnic Affairs in the Department of Community and Culture and the Department of Public Safety have offered answers to the following questions regarding the new law: Senate Bill 227 -Public Safety Driving and Identification Card Amendments.
Q: What does this law do?
A: This law revokes the use of an Individual Tax Identification Number (ITIN) issued by the Internal Revenue Service to obtain a Utah Driver's License or a State Identification Card. Those individuals using an ITIN will be issued a Driving Privilege Card rather than a “Driver's License”.
Q: When does this law begin?
A: This law took effect on March 8, 2005. Driver's Licenses issued with an ITIN will expire on the person's next birthday after July 1, 2005. This means that they will need to obtain a Driving Privilege Card to drive legally in the state.
Q: Are these Driving Privilege Cards only for Undocumented Individuals?
A: No .Driving Privilege Cards are not only for those who are undocumented. Anyone who does not have a Social Security number is eligible to obtain this card to drive. This will also include individuals who are legally present but do not qualify for a Social Security number, such as foreign students, foreign military personnel, foreign Olympic athletes, etc.
Q: Do you have to get a Driving Privilege Card if you have a valid Social Security number in your name?
A: No .If you obtained your Utah Driver's License using a valid Social Security number and not an ITIN, you do not have to obtain the Driving Privilege Card.
Q: Does the Driving Privilege Card allow you to get car insurance?
A: Yes .The Driving Privilege Card not only allows you to get car insurance but requires it. Utah law requires anyone operating a vehicle to have car insurance. It is against the law to drive without car insurance. If you currently do not have car insurance, we encourage you to obtain it.
Q: Can the Driving Privilege Card be used for Identification purposes?
A: Yes .The Driving Privilege Card may be used to identify yourself outside any governmental entity. Pulte Plans 5,000 Homes in Mesquite


MESQUITE, Nev. - Michigan-based Pulte Homes has begun selling homes in its 3,500-unit senior community in Mesquite, and will kick off sales in 2008 for its 1,500-home traditional community.

When built out in 2013 or 2014, the master-planned community could add as many as 10,000 new residents to Mesquite. Current population is estimated to be about 16,000.

Nearly 4,000 attended the opening of the sales center at Sun City Mesquite recently, and Pulte announced it already has more than 80 homes under contract. The builder projects it will have 200 home sales close in 2007 and between 500 and 800 in 2008.

Pulte expects some 30-40 percent of its purchasers in the senior community to be second home buyers, many who live in Las Vegas, Salt Lake City or California. Others will choose Mesquite as their primary residence, including those who currently live in Las Vegas, Pulte officials said.

Prices in Mesquite are 10 percent below what Pulte charges in Las Vegas, with homes starting at $190,000 and go as high as $500,000.

The opening comes during a slump in the housing market in Las Vegas. Builders have cut back on their production as demand has dropped because of a high inventory of existing homes and concerns over soaring real estate prices.

By aiming its community to seniors rather than first-time home buyers looking to commute to Las Vegas, Pulte is in a better position to deal with the slowdown, analysts say. But that doesn't mean there aren't challenges. Second home buyers and retirees are patient in making decisions.

But analysts say a senior community is the right target for Pulte given the success of nearby St. George in attracting retirees. Pulte has an advantage in that it has a good history of drawing from a list of its previous buyers. Pulte reports it has 14,000 people on its lead list.

Of the 3,500 homes, 10 percent can be sold to those between 50 and 55. The rest must be sold to those 55 and older. The development includes an 18-hole golf course, trails and parks and two senior-oriented recreation centers.

With more than 1,800 acres in the development, Pulte officials say it was logical to include traditional subdivisions for younger buyers. But there is a lot more demand for Mesquite as a retirement community. One reason is it doesn't have enough jobs, they said, to support traditional buyers.
